FEMA & funding

NRIs can purchase residential and commercial property in India (not agricultural land). Funding must come through NRE / NRO / FCNR accounts or through home-loan structures from Indian banks. Full repatriation up to USD 1M/year (of principal) is permitted with proper documentation.

Diligence you cannot skip

Title chain (30 years), RERA registration, occupancy certificate, society share certificate, no-dues from society and utilities. For under-construction — RERA-compliant escrow account and demand schedule.

Remote closing

Registration can be executed via a specific-purpose Power of Attorney (SPA) notarised at the Indian consulate. We facilitate the SPA drafting, KYC and registration end-to-end so you don't need to fly in.

Key takeaways

  • Fund via NRE/NRO/FCNR — never mix with resident income
  • Consular-notarised SPA lets you close remotely
  • RERA + title + society NOC are non-negotiable diligence
